By accessing or using MindDistil ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

MindDistil provides:

• Voice-to-text note capture and transcription
• AI-powered idea refinement and clarification
• Content generation based on your ideas and writing styles
• Project organization and workflow management
• Multi-platform content export

The Service uses artificial intelligence to transcribe, refine, and generate content. While we strive for quality, AI-generated results are advisory and should be reviewed before publishing.

3. User Accounts and Eligibility

Age Requirement: You must be at least 16 years old to use this Service. By creating an account, you confirm that you meet this age requirement.

To use certain features, you must create an account using Google OAuth. You are responsible for:

• Maintaining the security of your account
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

4. User Content

You retain ownership of content you create (notes, ideas, projects, generated content). By using the Service, you grant us a limited license to:

• Process and analyze your content to provide the Service
• Store your content securely for your access
• Transmit your content to AI providers for processing
• Generate anonymized, aggregated statistics from usage patterns

We do not use your content to train AI models. Your ideas and content remain yours.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Upload malicious content or attempt to compromise security
• Attempt to reverse engineer or scrape the Service
• Impersonate others or provide false information
• Use automated systems to access the Service excessively
• Resell or redistribute the Service without permission
• Use the Service to generate harmful, misleading, or illegal content

6. Service Tiers and Payments

Free Tier: Limited usage for personal exploration

Premium Subscription: Enhanced limits and features for a monthly or annual fee

Prices are subject to change with notice. Subscriptions auto-renew unless cancelled. Refunds are handled on a case-by-case basis.

7. AI and Third-Party Services

Our Service uses AI providers (Anthropic's Claude for refinement and generation, OpenAI's Whisper for transcription). By using the Service:

• You acknowledge that your content is processed by these AI services
• Your data may be transferred to the United States where these providers operate
• AI results are provided "as is" without guarantees of accuracy or suitability
• You should review AI-generated content before publishing

8. Voice Recording

When you use voice capture features:

• Audio is recorded on your device and transmitted to our servers
• Audio is sent to OpenAI Whisper API for transcription
• Audio files are processed temporarily and not persistently stored
• You are responsible for ensuring you have the right to record any content
• Do not record conversations with others without their consent where legally required

9. Generated Content Responsibility

You are solely responsible for content you publish using MindDistil:

• Review AI-generated content for accuracy before publishing
• Ensure content complies with platform terms where you publish (LinkedIn, Twitter, etc.)
• You bear responsibility for any claims arising from published content
• MindDistil is a tool; the final content decisions are yours

10. Intellectual Property

The Service, including its design, features, and content (excluding user content), is owned by MindDistil. You may not copy, modify, or create derivative works without permission.

Content you create and generate using the Service belongs to you, subject to any underlying third-party rights.

To the maximum extent permitted by law, MindDistil shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, reputation, or opportunities, arising from your use of the Service or content generated through it.

13. Indemnification

You agree to indemnify and hold harmless MindDistil from any claims, damages, or expenses arising from:

• Your use of the Service
• Content you create, generate, or publish
• Violation of these Terms
• Violation of any third-party rights

14. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason. You may delete your account at any time from your Profile page.

Upon termination, your right to use the Service ceases immediately. You may export your data before deletion.

15. Changes to Terms

We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the new Terms. We will notify users of significant changes via email or in-app notice.

16. Governing Law

These Terms are governed by the laws of the Republic of Poland. Any disputes arising from these Terms or your use of the Service shall be resolved in the courts of Poland.
